Some Oregon Medicaid Rules

(The numbers below change frequently - check with your attorney or
Oregon Seniors and People with Disabilities to stay current)

  • Applicant's Income Limit:

    $2,022 gross income per month (including Medicare Part B premium)
    !BUT if applicant's income exceeds this, talk with your attorney about an Income Cap Trust or court order for increased spousal support.
     

  • Resource Limits:

    If applicant is a single person: $2,000

    If applicant is a married person, then in addition to the applicant's $2,000, the well spouse may keep either:

    1. 1/2 of combined resources, up to $109,560 maximum, OR...
    2. Minimum of $21,912 of combined resources

      For example: If a couple has combined countable resources of $100,000, the well spouse can keep 1/2 of $100,000 or $50,000. They must spend the excess down to the Applicant's $2,000 limit, or in other words they must "spend down" $48,000 before the Applicant can qualify for Medicaid.

      For example: If a couple has combined countable resources of $300,000, the well spouse can keep 1/2 of $300,000 up to a maximum of $109,560. The ill spouse may keep up to $2,000. So, they must spend the excess down to their combined limit of $111,560, or in other words they must "spend down" $188,440 before the Applicant can qualify for Medicaid.

      For Example: If a couple has combined countable resources of $20,000, they can keep all of their assets up to $21,912 or the entire $20,000.
       

  • Transfer of Applicant's income to the community Spouse:

    If community spouse's income is less than $1,822/mo, she/he can receive increased amount of resources that generate income to bring her/his income up to $1,822.
